Cancellation & Refund Policy

1. Order Cancellations and Refunds

At Bhoosampatti®, we aim to ensure that every booking, project and order progresses smoothly. However, as we also depend on third-party stakeholders (such as developers, contractors, material suppliers, and service partners), there may be situations where we need to revise prices, timelines, or material specifications.

In such cases, we believe in being fair and transparent, and we allow cancellations as per the policy below.

i. Time Calculation
Time is calculated from the date on which the initial/booking amount is deposited (minimum 10% of the Estimated Project / Order Cost received by Bhoosampatti®).
If the customer fails to deposit the initiation amount within 45 days of booking, the project/order may be cancelled.

ii. Design Stage
The Design Stage is the period:

• After at least 0.5% of the project/order value is paid, and

• Before the remaining 9.5% (making total 10%) is paid and the designs are formally approved by the Bhoosampatti® production / construction team.

iii. Production / Construction Stage
The Production / Construction Stage begins:

• After 10% payment has been made, and

• Continues until 100% payment is completed and the project is delivered/closed.

iv. Policy Change After 60 Days – No Cash Refund
In such cases, no cash refund will be issued. However:

• The customer may use the full advance amount paid to purchase Bhoosampatti® products or services within 12 months of the original booking date.

• If no purchase (or only partial purchase) is made within 12 months, the unused amount will be forfeited.

• This clause is not applicable where full 10% payment has already been collected for projects where different contract terms may apply.

v. Design Stage Cancellations After 48 Hours – Partial Value Retention
In such cases, no cash refund will be issued. However:

• Customers may use up to 50% of the advance amount paid to purchase Bhoosampatti® products or services within 12 months of order booking.

• The remaining 50% will be treated as design, planning, and marketing costs and will be non-refundable.

vi. After Designs Are Finalized / During Production
Once designs are approved and the project is under production or construction:

• The project cannot be cancelled.

• No refund will be provided if the customer chooses to stop or cancel the project.

• The customer remains obligated to pay the remaining order / contract value as per the agreement with Bhoosampatti®.

4. Third-Party Products & Services

In addition to the above:

If you purchase or engage any products or services listed on Bhoosampatti.com that are offered by third-party vendors (“Vendors”) and not manufactured or directly delivered by Bhoosampatti®:

• Bhoosampatti® is not responsible for non-performance, delays, breach of contract, or deficiencies by any Vendor.

• Bhoosampatti® does not guarantee that any Vendor will complete a transaction or service.

• Bhoosampatti® makes no warranties regarding the quality, worth, suitability, or marketability of products or services offered by Vendors.

• Listings of Vendor products/services on the Site do not constitute endorsement or recommendation by Bhoosampatti®.

You agree to release and indemnify Bhoosampatti®, its officers and representatives from any liability, loss, or claim arising out of any act, omission, or default of such Vendors. You acknowledge that:

• Information provided by Vendors may be inaccurate, incomplete, or misleading.

• You must use your own judgment and caution when dealing with Vendors, including potential dealings with foreign nationals, underage persons, or people acting under false pretence.

All other terms in the main User Agreement / Terms & Conditions will also apply to such transactions.

5. Credit Card & Payment Details

• You confirm that any credit/debit card or payment method used on the Site is legally owned by you.

• You agree to provide correct and valid payment details.

• Bhoosampatti® will not use or share your card details with third parties except as required by law, regulation, payment gateway requirements, or court order.

Bhoosampatti® shall not be liable for any card-related fraud.
The responsibility for any fraudulent or unauthorized use of a card lies with the user, and the onus to prove otherwise rests solely with the user.

6. Fraudulent / Declined Transactions

Bhoosampatti® reserves the right to:

• Recover the cost of services, goods, collection charges, and legal fees from any user who uses the Site fraudulently.

• Initiate legal proceedings against such persons for fraudulent use of the Site or for any unlawful acts or omissions in breach of these terms.

7. Electronic Communications

By using Bhoosampatti.com, you consent to receive communications from Bhoosampatti® electronically.

We may communicate with you via:

• Email

• SMS

• WhatsApp

• Phone

• Website notifications

for purposes including (but not limited to):

• Order / project updates

• Policy changes

• Service information

• Promotional and transactional messages

8. Your Responsibilities – You Agree & Confirm

By using this Site and our services, you agree that:

i. In case of non-delivery or misdelivery caused by incorrect details provided by you (name, address, phone, email, etc.), any extra cost incurred by Bhoosampatti® may be charged to you.

ii. You will use the services of Bhoosampatti®, its partners, and affiliates only for lawful purposes and in compliance with applicable laws and regulations.

iii. You will provide accurate and authentic information whenever requested, and Bhoosampatti® reserves the right to verify such details and deny services if they are found to be false or misleading.

iv. You are accessing and transacting on the Site at your own risk and using your best and prudent judgment before entering into any transaction through the Site.

v. Any delivery address, project location, or contact details shared by you will be correct and complete in all respects.

vi. Before confirming any order, booking, or project, you will carefully review the description, inclusions, exclusions, and conditions of sale. By placing a booking or order, you agree to be bound by such conditions.

9. Prohibited Use of the Site

You agree not to use the Bhoosampatti® Site for:

• Disseminating unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material

• Transmitting content that encourages conduct amounting to a criminal offence or civil wrong, or violates any law or code of practice

• Gaining unauthorized access to other systems, accounts, or networks

• Interfering with other users’ use or enjoyment of the Site

• Violating any applicable laws or regulations

• Interfering with or disrupting networks or websites connected to the Site

• Making, transmitting, or storing copies of materials protected by copyright without permission of the owner
